Today we have been 7 days without running water, this is one of several times within the past couple of years this happened because he does not view the contract he inherited or our lack of running water to be of his concern. The current Reclamation Plan for Cemex Lyons includes a surety bond of approximately $8.9MM, which is based on estimates from nearly 20 years ago. DRMS has previously indicated that this bond amount is likely inadequate in present day dollars and needs to be reassessed. Semi-related, the Reclamation Plan also now calls for the burial of concrete rubble and the onsite disposal of various materials, which is a significant modification to the Reclamation Plan and was approved via a Technical Revision in the 2001/2002 timeframe without an Amendment and the corresponding public notice process. In light of the above, specifically the modification to the Reclamation Plan without public comment and notice and the inadequacy of the surety bond, I believe that an Amendment process for the Lyons Quarry Permit M1977208 that includes a public notice process is warranted. The surety bond amount must also be increased to cover the current cost of reclamation as a figure not updated over the past 20 years, is surely inadequate. Given Cemex's poor performance in the stock market, and a current liquidity ratio of only 0.87 based on the three months ending September 30, 2022, I have serious concerns about their ability to pay for proper reclamation of their Lyons property, as a ratio of less than 1 typically means that a company is facing negative working capital, and may be experiencing a liquidity crisis. We have observed approximately 10 trucks per hour on US-36, and have reports of similar new truck traffic on Highway 66. - In DRMS parlance, this is an alteration, as it changes the plant from a connected "Mining Operation" to a "Custom Mill”. - DRMS has previously indicated that the mining activities still occurring at the Lyons Quarry is the processing of material mined from the Dowe Flats Mine, and if mining at the Dowe Flats Mine were to cease (which it has), that would have implications on the Lyons Quarry permit. Any changes to the previously approved plan, such as changing the primary source location of their raw materials, would need to be reviewed by DRMS through the appropriate revision submission. - DRMS also indicated that should CEMEX want to propose leaving the cement plant operations in place, this would need to be submitted to DRMS in the form of an Amendment application (to change the post-mining land use to industrial/commercial). Of course, CEMEX would need to demonstrate this proposal is compliant with local land use and zoning requirements. I believe that the recent closure of the Dowe Flats mine, and CEMEX’s decision to continue operating the plant by trucking in raw materials means that CEMEX must request an amendments to Lyons Quarry Permit M1977208, or at a minimum, file for a Technical Revision. An expansion of use beyond that does not seem appropriate. We discussed the original use with SEMA operator when the project started. While we don't agree with embarking on a project of this scale with no county approval and no ability for public input, we have decided not to pursue further actions regarding the use of this pit specifically for I-25.
